Zome Terms of Service

Provider: Phi Labs Technology Ltd, a company registered in Nigeria (RC 9063518), of Lagos, Nigeria. Contact: support@myzome.app Governing law: the laws of the Federal Republic of Nigeria.

These terms are an agreement between you and Phi Labs Technology Ltd. By creating a Zome account you accept them. If you do not accept them, do not use Zome.


1. Definitions

In these Terms, the following words have the following meanings, and a defined word carries that meaning wherever it appears with a capital letter:

PlanThe Proactive Path generated for you: a sequence of daily goals over a defined period.
ProfileYour age band, sex, height, weight, name and nickname.
Provider, we, us, ourPhi Labs Technology Ltd, a company registered in Nigeria under number RC 9063518, of Lagos, Nigeria.
ServicesThe Zome mobile application, the Zomy messaging assistant, and any related service we provide.
ZomyThe messaging assistant that sends your daily goal and receives your replies, where you have enabled it.
you, yourThe individual who has accepted this Agreement and holds an Account.

1.1 Headings are for convenience and do not affect interpretation.

1.2 "Including" and "such as" introduce examples and do not limit what precedes them.

1.3 A reference to a statute includes any amendment or re-enactment of it.

1.4 Where this Agreement and the Privacy Policy conflict on the handling of personal data, the Privacy Policy prevails.


2. What Zome is

Zome looks at data your phone already collects about your body, together with what you tell it, and turns that into a plan for the next 28 days. It scores areas of your health — movement, food, recovery, strength and how you are feeling — and suggests one small thing to do each day.

That is all it is. It is a way of noticing what your own measurements are already saying, and acting on it a little at a time.


3. Zome is not medical care

This is the most important section in this document. Please read it.

  • Zome is not a medical device. It does not diagnose, treat, cure, prevent or monitor any disease, injury or condition.
  • Zome is not a doctor and does not replace one. Nothing in the app is a medical opinion about you, and no score is a finding about your health.
  • Never use Zome to decide whether to seek care. If something is wrong, see a doctor. If it is urgent, call emergency services. Do not wait for a score to change.
  • Never change medication, treatment, or a clinician's advice because of anything Zome says.
  • Talk to a doctor before starting new exercise or changing what you eat — particularly if you are pregnant, or have a heart condition, an eating disorder, diabetes, an injury, or any diagnosed condition.

Zome's numbers come from data of varying quality: some of it is self-reported, and some comes from consumer sensors that are not clinical instruments. Where the app does not have enough evidence to say something, it says so rather than guessing. Where it does say something, it is describing your own measurements — not making a finding about your health.


4. Your account

  • You need an account, and the email address you give must be one you control.
  • One account per person. Do not share it.
  • You are responsible for what happens under your account. Keep your password and your device secure.
  • You must be 18 or over. Zome is for adults; see the Privacy Policy for why the bar is there and not lower.
  • If you think somebody else has got into your account, tell us at support@myzome.app and end every session from Settings → Account.

5. Your data

What we collect and why is in the Privacy Policy, which forms part of these terms.

In short: your health data is yours. We hold it to run the product for you, we never sell it, no advertiser or insurer ever sees it, and you can delete all of it from inside the app — Settings → Account → Delete account. That deletion is immediate, permanent and unrecoverable.


6. Messages

If you turn on iMessage reminders, we send you your daily goal and read your replies to record whether you kept it.

  • You choose to turn this on. It is off until you do, and turning it on is your express consent to receive automated messages at the number you give us.
  • Reply STOP at any time and we stop, permanently. We do not treat a later message from you as permission to start again — you have to turn it back on yourself. HELP gets you help.
  • We send at most one reminder a day, at a time you choose.
  • Message and data rates from your carrier may apply.
  • Reminders are not urgent notifications. Do not rely on them for anything that matters medically.

7. What you may not do

  • Use Zome to give anybody else medical advice.
  • Access, or try to access, another person's account or data.
  • Feed the app fabricated data and then rely on the result.
  • Copy, resell, or redistribute the app or its content.
  • Automate access to our API from outside the app, or work around its rate limits.
  • Use Zome to build a competing product, or to train a model on its outputs.

We may suspend an account being used to do any of these.


8. Availability

Zome is provided as it is. We do not promise it will always be available, that it will be free of faults, or that any particular outcome will follow from using it. We may change, suspend or discontinue features.

If we discontinue Zome, we will give you reasonable notice and a way to get your data out before it stops.


9. What we are responsible for, and what we are not

Nothing in this section takes away a right you have by law. If you are a consumer in Nigeria, the UK, the EEA or a US state whose law says otherwise, that law wins over anything written here.

We do not exclude, and could not exclude, our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Subject to that, and because Zome is provided free of charge:

  • We are not liable for indirect or consequential loss: lost profits, lost opportunity, lost data, or the cost of substitute services.
  • We are not liable for any decision you make about your health. Section 2 is the whole of it: Zome is not medical care, and nothing it shows you is a finding about your body. If something is wrong, see a doctor.
  • We are not liable for what other people's services do — Apple Health, the network your phone is on, the services listed in §11.
  • Where liability cannot be excluded but can be limited, ours is limited to the greater of the amount you have paid us in the twelve months before the claim, or ten thousand naira.

What we are responsible for is running the service described here honestly: holding your data as the Privacy Policy says we do, not selling it, deleting it when you ask, and telling you if something goes wrong with it.


10. What Zome costs

Zome is free while it is in beta. There is no subscription, no trial that converts, and no payment details are collected anywhere in the app.

If that changes, we will tell you in the app before it does, and nothing you already have will start costing money without you choosing it. Any future subscription would be sold and billed by Apple through your App Store account, managed in your Apple ID settings, and subject to Apple's terms as well as these.


11. How Zome uses AI, and what it is not allowed to do

A language model writes the wording of your plan. That is the whole of its job.

It never measures anything. It cannot compute a score, create an observation, change a confidence figure, or produce a plan that has not already passed our own checks. Every number in Zome comes from fixed rules working on your measurements. The model chooses words for decisions those rules have already made.

What it receives: your Zome scores, the shape of your plan, and any barriers you have told us about. What it never receives: your email, your name, your phone number, or your raw health measurements.

It is not a chatbot and not a clinician. Zomy, in Messages, answers from fixed rules rather than a model, and it will tell you plainly that it cannot give health or medical advice, because it cannot.


12. Changes, and leaving

Changing these terms. If we change them in a way that affects you, we will tell you in the app before it takes effect. Carrying on using Zome after that is how you accept the change; if you would rather not, delete your account.

Leaving. Delete your account in the app: Settings → Account → Delete my account. It takes two taps and a Face ID check, and it happens immediately. We do not ask you to email anybody, and we will never make leaving harder than joining was.

Three things deletion does not reach, said here because knowing afterwards is too late:

  • Apple Health. Data your phone saved into Apple Health is your phone's, not ours. Remove it in the Health app, under your profile.
  • iMessage. The service that delivers your reminders holds the conversation and your phone number, which we have never stored. We record a request to erase it and pass it on; until they act, their retention applies.
  • The fact that a deletion happened. We keep a dated record with nothing in it that identifies you, because being able to show that we deleted something is part of having deleted it.

Ending it from our side. We may close an account that is being used to break §7, or where the law requires it. We will tell you why, and give you a way to get your data out first unless doing so would be unlawful.


13. Other people's services

Zome depends on services from others, and their terms apply to their part:

Nutrient information comes from Open Food Facts, a public database maintained by volunteers. It can be wrong, and we do not verify it. Treat it as a guide, not a measurement.


14. Disputes and governing law

14.1 Talk to us first. If you have a complaint, write to support@myzome.app setting out what has happened and what you would like us to do. We will acknowledge within 5 working days and give a substantive response within 30 days. Most things end here, and neither of us needs a court.

14.2 Governing law. This Agreement, and any dispute arising out of or in connection with it, including any non-contractual dispute, is governed by the laws of the Federal Republic of Nigeria.

14.3 Jurisdiction. The courts of the Federal Republic of Nigeria have jurisdiction. This does not take away a right you have under the law of the country you live in. If the law where you live gives you the right to bring proceedings in your own local courts, or applies protections that cannot be contracted out of, you keep that right and those protections.

14.4 Regulators. Nothing in this section affects your right to complain to a data protection authority. Those routes are set out in the Privacy Policy.

14.5 No class actions are waived, and no arbitration is imposed. We have deliberately not required you to arbitrate or to give up any collective remedy.


15. General

15.1 Entire agreement. This Agreement is the whole agreement between you and us about the Services, and replaces anything said or written before it. Nothing in this clause limits liability for fraud or fraudulent misrepresentation.

15.2 Severability. If any provision of this Agreement is found to be unlawful or unenforceable, it is severed to the minimum extent necessary and the rest continues in force. Where a provision can be made enforceable by narrowing it, it applies as narrowed rather than being struck out.

15.3 Waiver. If we do not enforce a provision, or delay in doing so, that is not a waiver of it and does not prevent us enforcing it later. A waiver is effective only if we give it in writing.

15.4 Assignment. You may not assign or transfer this Agreement or your Account. We may assign this Agreement to a group company, or to a buyer of the business or its assets, provided your rights under it are not reduced. We will tell you in the app before any such transfer takes effect, and the Privacy Policy sets out what happens to your data.

15.5 Force majeure. Neither party is liable for a failure to perform caused by something outside its reasonable control, including a failure of the public internet, a power failure, an act of a government or regulator, or an outage at a supplier named in the Privacy Policy. This does not excuse a failure to refund money owed to you.

15.6 Notices. We give you notice through the app or by email to the address on your Account, and it is treated as received when sent. You give us notice by email to support@myzome.app, and it is treated as received when we acknowledge it. Keep your email address current: it is the only way we can reach you.

15.7 Survival. Clauses 1, 3, 5, 9, 14 and 15 survive the ending of this Agreement, together with anything else which by its nature is intended to.

15.8 No third-party rights. Nobody who is not a party to this Agreement may enforce it.

15.9 Language. This Agreement is made in English. Any translation is for convenience, and the English text governs.

15.10 Relationship. Nothing here makes either of us the agent, partner or employee of the other.
